Moxie helps businesses plan, create, review, publish, manage and analyse marketing content and campaigns across connected digital platforms.

This Privacy Policy explains how we collect, hold, use and disclose personal information when you:

  • Visit the Moxie website;
  • Create or use a Moxie account;
  • Join a Moxie workspace;
  • Connect a social media, advertising or other third-party account;
  • Use Moxie's content creation, approval, publishing, analytics or automation features;
  • Communicate with our team; or
  • Otherwise interact with Moxie.

We handle personal information in accordance with applicable privacy laws, including the Australian Privacy Principles where they apply.

2. Who this policy applies to

This policy applies to:

  • Moxie account holders;
  • Users invited into a Moxie workspace, including content reviewers invited through a Moxie review room;
  • Employees, contractors and representatives of Moxie customers;
  • People who interact with content, advertisements, forms or accounts managed through Moxie;
  • Website visitors; and
  • People who contact us.

A business using Moxie may also have its own privacy obligations and privacy policy. Where a Moxie customer collects or controls personal information through its connected accounts, the customer is responsible for ensuring that it has the necessary authority to collect, use and provide that information to Moxie.

3. Information we may collect

The information we collect depends on how you use Moxie and which services you connect.

Account and identity information

We may collect:

  • Your name;
  • Email address;
  • Login and authentication information;
  • Job title or role;
  • Business or organisation name;
  • Workspace membership and permissions; and
  • Account preferences.

Business and workspace information

We may collect information about the business or organisation using Moxie, including:

  • Business name and contact details;
  • Brand information;
  • Brand guidelines;
  • Logos, images, colours and fonts;
  • Products and services;
  • Target audiences;
  • Marketing preferences;
  • Approval requirements;
  • Team members and responsibilities; and
  • Content, campaign and publishing settings.

Information from connected platforms

When you choose to connect a third-party platform, Moxie may receive information made available through that platform’s APIs and the permissions you approve.

For Meta products, this may include information associated with connected Facebook Pages, Instagram professional accounts, Meta business accounts, advertising accounts and lead-generation tools, such as:

  • Account, Page, business and advertising account identifiers;
  • Account names, usernames and profile information;
  • Access tokens and connection status;
  • Page and account roles or permissions;
  • Posts, captions, media and other published or scheduled content;
  • Comments, replies and engagement information;
  • Advertising campaigns, ad sets, advertisements and creative assets;
  • Advertising expenditure, delivery and performance information;
  • Audience and aggregated analytics information;
  • Leads submitted through connected lead forms;
  • Messages or conversations, where Moxie has been granted the relevant permission and the messaging feature is in use;
  • Webhook events and platform notifications; and
  • Other information you expressly authorise the platform to provide to Moxie.

Moxie will only request access to platform information that is reasonably required to provide the features you have selected.

You can revoke Moxie’s access through the connected platform or through the relevant account settings provided by that platform.

Content and files

We may collect information that you upload, create or manage through Moxie, including:

  • Written content;
  • Images and creative assets;
  • Campaign briefs;
  • Content calendars;
  • Feedback, comments and approvals;
  • Ideas and suggestions submitted by team members;
  • Marketing instructions;
  • Templates; and
  • AI-generated or AI-assisted content.

Content uploaded to Moxie may contain personal information about other people. You must ensure that you have the authority to provide that information to Moxie.

Lead and customer information

Where you connect lead-generation tools, Moxie may process information relating to your customers or prospective customers, including:

  • Names;
  • Email addresses;
  • Telephone numbers;
  • Lead-form responses;
  • Campaign attribution;
  • Enquiry details;
  • Consent or opt-in information; and
  • Lead status and related notes.

Moxie processes this information on behalf of the business that controls the relevant workspace or connected account.

Usage and technical information

We may automatically collect technical and usage information, including:

  • Internet Protocol address;
  • Browser and device information;
  • Operating system;
  • Login times;
  • Pages and features used;
  • Session, event and diagnostic information;
  • Error and performance logs;
  • Referring website information;
  • Approximate location derived from an IP address; and
  • Security and audit records.

Communications and support information

When you contact us, we may collect:

  • The contents of your enquiry;
  • Support correspondence;
  • Feedback;
  • Complaint information;
  • Call or meeting notes; and

Billing information

Moxie does not currently offer paid subscriptions. If paid services are offered in the future, we may collect billing contact details, subscription information, transaction records and limited payment information. Full payment-card details would be collected and processed directly by a third-party payment provider rather than stored by Moxie, and this policy would be updated accordingly.

  • From the business or organisation that invites you to Moxie;
  • When you create or update an account;
  • When you upload or enter information into Moxie;
  • Through connected third-party platforms;
  • Through APIs, webhooks and authorised integrations;

  • Automatically through cookies, logs and similar technologies; and
  • From service providers that assist us in operating Moxie.

We may collect, hold and use information to:

  • Create and administer Moxie accounts and workspaces;
  • Authenticate users and manage permissions;
  • Connect Moxie with authorised third-party platforms;
  • Create, schedule, publish and manage marketing content;
  • Manage content review and approval workflows;
  • Operate advertising and campaign-management features;
  • Receive and manage leads;
  • Provide reporting, analytics and recommendations;
  • Personalise Moxie to a business's brand, preferences and prior feedback;
  • Generate, edit, classify or analyse content using artificial intelligence;
  • Improve Moxie's features, reliability and usability;
  • Provide customer support;
  • Send service-related communications;
  • Detect, prevent and investigate fraud, abuse or security incidents;
  • Maintain audit, compliance and operational records;
  • Enforce our agreements and policies;
  • Comply with legal obligations; and
  • Protect the rights, safety and security of Moxie, our customers and other people.

We will not use information received from Meta products for purposes prohibited by Meta’s terms or platform policies.

6. Artificial intelligence

Some Moxie features use artificial intelligence to assist with activities such as:

  • Generating marketing ideas and content;
  • Drafting captions and campaign material;
  • Reviewing brand consistency;
  • Analysing feedback;
  • Classifying leads, comments, content or campaign information;
  • Recommending changes;
  • Creating or editing images; and
  • Automating approved marketing workflows.

Information submitted to an AI-assisted feature may be processed by Moxie and by third-party AI service providers engaged to deliver that feature.

Moxie will seek to limit the information provided to AI service providers to what is reasonably necessary for the relevant function. You should not submit sensitive or confidential personal information to an AI feature unless it is necessary, authorised and appropriate to do so.

AI-generated material may contain errors. Users remain responsible for reviewing and approving content and decisions where human review is required.

7. When we may disclose information

We may disclose information to:

  • The business or organisation that controls your Moxie workspace;
  • Authorised users within your workspace;
  • Social media, advertising and other platforms you choose to connect;
  • Cloud hosting, database, authentication and infrastructure providers;
  • AI and machine-learning service providers;
  • Email, communications and notification providers;
  • Security and monitoring providers;
  • Professional advisers, including lawyers, accountants and insurers;
  • Contractors assisting us in operating Moxie;
  • Law-enforcement agencies, regulators, courts or government bodies where required or authorised by law;
  • A purchaser, investor or adviser involved in a proposed sale, restructure or transfer of Moxie or its business; and
  • Other parties where you have directed or authorised us to disclose the information.

We do not sell personal information to data brokers or advertisers.

8. Third-party platforms

Moxie allows you to connect services operated by third parties, including social media, advertising, communications and business software providers.

Your use of those services remains subject to the third party’s own terms and privacy policy. Moxie does not control how a third-party platform independently collects or uses information.

Disconnecting a platform will stop Moxie from receiving new information through that connection. It may not automatically delete information previously received by Moxie.

9. Overseas processing and disclosure

Moxie uses technology and service providers located outside Australia.

As a result, personal information may be stored or processed in Australia, the United States and other countries in which our service providers or their infrastructure operate.

Privacy protections in another country may differ from those available in Australia. Where required, we take reasonable steps to ensure overseas recipients handle personal information consistently with applicable Australian privacy requirements.

The countries and providers used by Moxie may change as our infrastructure develops. You may contact us for further information about the providers relevant to your information.

10. Data storage and security

We take reasonable technical and organisational measures to protect information against:

  • Loss;
  • Misuse;
  • Interference;
  • Unauthorised access;
  • Unauthorised modification; and
  • Unauthorised disclosure.

These measures may include:

  • Access controls and role-based permissions;
  • Encryption in transit and, where appropriate, at rest;
  • Secure authentication;
  • Logging and audit records;
  • Restricted administrative access;
  • Monitoring and security testing;
  • Backups and recovery processes; and
  • Staff and contractor confidentiality obligations.

No internet-based service can be guaranteed to be completely secure. Users are responsible for maintaining the security of their login credentials and connected accounts.

Please contact us promptly if you believe your Moxie account or information has been accessed without authorisation.

11. How long we retain information

We retain personal information only for as long as reasonably necessary to:

  • Provide Moxie's services;
  • Maintain the relevant account or workspace;
  • Fulfil the purpose for which the information was collected;
  • Meet contractual, legal, tax, accounting or regulatory obligations;
  • Resolve disputes;

  • Maintain appropriate operational and security records.

Retention periods may differ depending on the type of information and the reason it is held.

When personal information is no longer required, we will take reasonable steps to delete or de-identify it, unless we are legally required or otherwise permitted to retain it.

Information may remain in encrypted backups for a limited period until those backups are overwritten or securely deleted.

12. Access and correction

You may request access to personal information that we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.

Some information can be reviewed or updated directly within your Moxie account.

Requests can be sent to privacy@themoxie.app. We may need to verify your identity before providing access or making a correction.

In some circumstances, applicable law may permit or require us to refuse access. Where appropriate, we will explain the reason for the refusal.

13. Deleting your information

You may request deletion of information associated with your Moxie account or a connected platform.

Deletion may be subject to identity verification and any legal, security, accounting, dispute-resolution or record-retention requirements that apply.

Deleting information from Moxie does not necessarily delete information held independently by Facebook, Instagram, Meta or another connected service.

14. Cookies and similar technologies

Moxie uses cookies, local storage and similar technologies to:

  • Keep users signed in;
  • Maintain account security;
  • Remember preferences;
  • Diagnose errors; and
  • Improve performance.

You may be able to manage cookies through your browser settings. Disabling essential cookies may prevent parts of Moxie from working correctly.

15. Marketing communications

Where permitted, we may send information about Moxie products, features or services.

You can unsubscribe from marketing communications by using the unsubscribe option in the communication or contacting us.

We may still send important account, security, billing or service-related communications.

16. Children

Moxie is intended for use by businesses and authorised adult users. It is not directed to children under 16, and we do not knowingly invite children to create Moxie accounts.

Please contact us if you believe a child has provided personal information to Moxie without appropriate authorisation.

17. Privacy complaints

You may contact us if you have a question or complaint about how we have handled personal information.

Please provide enough information for us to understand and investigate the matter. We will acknowledge and investigate complaints within a reasonable period.

If you are not satisfied with our response, you may be entitled to contact the Office of the Australian Information Commissioner or another relevant privacy regulator.

We may update this Privacy Policy as Moxie develops or as legal, regulatory or technical requirements change.
